TILES Algebra Tiles Board End User Licence Agreement

1. About this agreement

This End User Licence Agreement (“EULA”) is a legal agreement between you and Christian Parkinson (trading as CP3 Maths) for your use of the Algebra Tiles Board feature of TILES, including its standalone website, progressive web app, software, interface, documentation, updates and associated materials (together, the “Algebra Tiles Board”).

By selecting “Agree & continue”, installing, accessing or using the Algebra Tiles Board, you agree to this EULA. If you do not agree, do not use the Algebra Tiles Board.

2. Who may use the Algebra Tiles Board

The Algebra Tiles Board is available to individual users, families, teachers, tutors, schools and other organisations. If you use it on behalf of another person or organisation, you confirm that you have authority to accept this EULA for that use.

If you are under 18, you should use the Algebra Tiles Board only with the permission of a parent, guardian, teacher or other responsible adult. That adult or the relevant school or organisation remains responsible for deciding whether the Board is suitable for you.

3. Licence to use the Algebra Tiles Board

Subject to this EULA, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Algebra Tiles Board for lawful personal, educational, classroom, tutoring, training and internal organisational purposes.

The Algebra Tiles Board is licensed, not sold. No ownership rights are transferred to you.

4. Permitted educational use

You may display and use the Algebra Tiles Board when teaching, learning, explaining, demonstrating or practising mathematics. You may take ordinary screenshots of your own board arrangements for lawful educational use, provided that you do not misrepresent ownership of the Algebra Tiles Board or remove visible ownership notices.

6. Ownership and intellectual property

The Algebra Tiles Board and all intellectual property rights in it are owned by CP3 Maths, except for components expressly identified as third-party materials. Protected original materials include its source and object code, software structure, interface, visual design and layout, branding, logos, custom SVG icons and icon artwork, animations, interface graphics, legal documentation and other original materials.

The Nunito and Montserrat font software included with the Algebra Tiles Board is distributed under the SIL Open Font License 1.1. The applicable notices are available with the font files: Nunito licence and Montserrat licence.

7. Your board arrangements and device storage

You retain any rights you hold in material you create independently. The current public release does not provide an account, cloud storage or sharing of board arrangements with CP3 Maths. A non-empty board may be remembered locally on your device for up to 30 days after it was last updated, so that you can choose whether to continue it when you return.

The optional feedback form lets you select a screenshot from your device. If you submit feedback, you confirm that you are entitled to share its contents and permit CP3 Maths and its delivery provider to process, transmit and retain the feedback, screenshot and selected diagnostics solely to investigate problems, respond where possible, improve TILES, maintain security or deal with legal claims. Do not include personal, confidential or safeguarding-sensitive information.

Locally remembered board state may expire or be lost if you start with a clean board, clear browser data, use private browsing, change browser or change device. More information is provided in the Privacy Policy.

Do not enter or display personal, confidential or safeguarding-sensitive information on a board where other people can see it.

8. Free, paid and subscription features

Some parts of the Algebra Tiles Board may be offered free of charge and other features may later require a purchase, subscription or organisational licence. The features included in each plan may differ.

Before a paid contract is made, the relevant price, billing period, renewal arrangements, cancellation method, included features and any applicable trial or refund information will be shown separately. Those purchase or subscription terms will form part of your agreement with CP3 Maths. Nothing in this EULA removes consumer rights that apply by law.

9. Updates, availability and changes

The Algebra Tiles Board may be updated, corrected, improved or changed. Features and compatibility may change between versions. Access may occasionally be interrupted by maintenance, network, hosting, browser or device issues.

A material EULA update will use a new version number and may require you to accept the updated EULA before continuing. If the Algebra Tiles Board is withdrawn permanently, any rights relating to an existing paid subscription will be handled in accordance with its purchase terms and applicable law.

10. Educational use and responsibility

The Algebra Tiles Board is an educational support tool. It does not replace professional teaching, curriculum, assessment, accessibility, safeguarding or supervision decisions. Teachers, parents, tutors and organisations remain responsible for deciding how it is used and whether it is appropriate for their learners.

No particular learning, examination or assessment outcome is guaranteed.

11. Consumer rights and warranties

Nothing in this EULA excludes or limits any statutory right or remedy that cannot lawfully be excluded or limited. Where the law requires it, digital content or services will be provided with reasonable care and skill and will correspond with their description.

Subject to those rights, the Algebra Tiles Board is supplied on an “as available” basis. It is not promised that the service will always be uninterrupted, error-free or compatible with every device, browser, network or accessibility tool.

12. Liability

Nothing in this EULA excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.

To the extent permitted by law, CP3 Maths is not responsible for losses that were not reasonably foreseeable, were not caused by a breach of this EULA, or arise from network failure, unsupported devices, browser storage being cleared, locally lost board state, or decisions made using the Algebra Tiles Board.

If you use the Algebra Tiles Board wholly or mainly for business purposes, CP3 Maths is not liable for loss of profit, revenue, business, opportunity, goodwill, anticipated savings or indirect or consequential loss, to the extent permitted by law.

13. Ending this licence

You may end this EULA at any time by stopping use and removing any installed copy. The licence may be suspended or terminated if you materially or repeatedly breach this EULA or if access must be restricted for legal, security or operational reasons. When the licence ends, you must stop using the Algebra Tiles Board.

Ending this licence does not automatically cancel or refund a paid subscription. Any subscription must be ended using the cancellation method stated when it is purchased, subject to applicable law.

14. General legal terms

If any part of this EULA is found to be invalid or unenforceable, the remaining provisions will continue to apply. A delay in enforcing this EULA does not waive the right to enforce it later. You may not transfer your rights under this EULA without written permission from CP3 Maths.

15. Governing law

This EULA is governed by the laws of England and Wales, subject to any mandatory rights that apply where you live. The courts of England and Wales will have jurisdiction unless applicable law gives you the right to bring proceedings elsewhere.
